Removal of Material for Alleged Copyright Infringement

Wallppr.com is committed to respecting and protecting the intellectual property rights of others. We adhere to the Digital Millennium Copyright Act (DMCA) in the United States and the European Union Copyright Directive (EUCD) in the European Union, which outline a process for addressing claims of copyright infringement.

When we receive a valid DMCA or EUCD notice, we respond by removing or disabling access to the allegedly infringing material. We also make a good-faith attempt to contact the content owner so they may make a counter-notification.

How to File a DMCA or EUCD Notification

If you are a copyright owner or authorized to act on behalf of one, and you believe that a copyright infringement has occurred on Wallppr.com, please provide our Copyright Agent with the following information:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing or subject to infringing activity, and information reasonably sufficient to allow us to locate the material (preferably a URL).
  4. Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to legal action and damages, including costs and attorney fees.

How to File a Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may send a counter-notification with the following information:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before removal or disabling.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled due to mistake or misidentification.
  4. Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the relevant courts, and a statement that you will accept service of process from the person who filed the infringement notice.

Policy Regarding Repeat Infringers

In accordance with the DMCA and EUCD and in appropriate circumstances, Wallppr.com will terminate the accounts of users who are deemed to be repeat infringers. We also reserve the right to decide whether content violates our Terms of Service for reasons other than copyright infringement and may remove such content or terminate a user’s account due to a violation of our Terms of Service at our sole discretion.
